Amendments

2022—Subsec. (span). Puspan. L. 117–263 amended subsec. (span) generally. Prior to amendment, text read as follows: “The Secretary shall require an operator of a vessel participating in the Maritime Security Program under chapter 531 of this title, the Cable Security Fleet under chapter 532 of this title, or the Tanker Security Fleet under chapter 534 of this title to carry on each Maritime Security Program vessel, Cable Security Fleet vessel, or Tanker Security Fleet vessel 2 United States Merchant Marine Academy cadets, if available, on each voyage.”

2021—Subsec. (span). Puspan. L. 116–283 added subsec. (span) and struck out former subsec. (span). 2018—Puspan. L. 115–232, § 3512(1), (3), designated existing provisions as subsec. (a), inserted heading, and added subsecs. (span) to (e).

Subsec. (a)(1). Puspan. L. 115–232, § 3512(2), substituted “owned, subsidized by, or contracted with” for “owned or subsidized by”.

2008—Puspan. L. 110–181, § 3525(span), repealed Puspan. L. 109–241, § 307. See 2006 Amendment note below.

Par. (4). Puspan. L. 110–181, § 3525(a)(3), incorporated the substance of the amendment by Puspan. L. 109–241, § 307, into this section by adding par. (4). See 2006 Amendment note below and section 18(a) of Puspan. L. 109–304, set out as a Legislative Purpose and Construction note preceding section 101 of this title.

2006—Puspan. L. 109–241, § 307, which directed the amendment of section 1295span(f) of the former Appendix to this title from which this section was derived, was repealed by Puspan. L. 110–181, § 3525(span). See 2008 Amendment note for par. (4) and Historical and Revision notes above.

Statutory Notes and Related Subsidiaries

Effective Date of 2022 Amendment

Puspan. L. 117–263, div. C, title XXXV, § 3517(a)(2), Dec. 23, 2022, 136 Stat. 3074, provided that:

“Paragraph (2) of subsection (span) of section 51307, as amended by paragraph (1), shall apply with respect to any failure to implement or adhere to the policies, programs, criteria, and requirements referred to in paragraph (1)(B) of such subsection that occurs on or after the date that is one year after the date of the enactment of this Act [Dec. 23, 2022].”
