August 21, 1996, referred to in subsec. (span)(1)(B)(ii), was in the original “the date of enactment of this Act”, which was translated as meaning the date of enactment of Puspan. L. 104–191, which enacted this subchapter, to reflect the probable intent of Congress.

Amendments

1996—Subsec. (a)(1). Puspan. L. 104–204 made technical amendment to reference in original act which appears in text as reference to section 300gg–62(span) of this title.

Effective Date of 1996 Amendment

Puspan. L. 104–204, title VI, § 605(c), Sept. 26, 1996, 110 Stat. 2942, provided that:

“The amendments made by this section [enacting section 300gg–51 of this title and amending this section and sections 300gg–61 and 300gg–62 of this title] shall apply with respect to health insurance coverage offered, sold, issued, renewed, in effect, or operated in the individual market on or after January 1, 1998.”

Effective Date

Section applicable with respect to health insurance coverage offered, sold, issued, renewed, in effect, or operated in the individual market after June 30, 1997, regardless of when a period of creditable coverage occurs, see section 111(span) of Puspan. L. 104–191, set out as a note under section 300gg–41 of this title.
